Terms of use

By accessing and using the 8008gear.com website (hereinafter — the “Site”), you confirm that you have read and accept these Terms of Use, the Privacy Policy and the notice on the processing of personal data. If you do not agree with the terms, please do not use the Site.

If you place an order, the provisions of the distance sales agreement, the shipping policy, the return policy and the warranty terms apply in addition to these terms.

1. General provisions

1.1. The Site is an online store operated by 8008 Gear — (official name of the legal entity / sole proprietor) (hereinafter — “8008 Gear”) where gaming gear and accessories are offered and sold remotely.

1.2. The Site’s services may be used by people aged 18 and over with full legal capacity. People under 18 may use the Site only with the consent and supervision of a legal representative.

2. Account and security

2.1. The information you provide when creating an account must be accurate and up to date.

2.2. The user is responsible for keeping their account login details confidential. If you believe there has been unauthorized access to your account, please contact us immediately.

2.3. 8008 Gear reserves the right to restrict or suspend an account created with false information, that violates the rights of third parties or is used to abuse the Site. Where possible, the user is notified in advance.

2.4. The user may request the deletion of their account at any time. Order data that the law requires to be kept is retained until the relevant period expires.

3. Product information, prices and stock

3.1. Product names, images, technical specifications, prices and stock levels on the Site are kept as accurate and up to date as possible. However, some information may differ due to changes the manufacturer makes to a product’s specifications, appearance or packaging. If such a difference affects your order, you are informed before the product is shipped.

3.2. Depending on your monitor settings, a product’s color may look different in the photo. This difference is not considered a defect.

3.3. Prices and stock levels may change without notice. A confirmed order is charged at the price in effect at the time the order was placed.

3.4. If an obviously incorrect price or information is shown on the Site for technical reasons, 8008 Gear has the right to cancel the order before it is fulfilled after informing the buyer; in this case the amount paid is refunded in full.

4. Orders and payment

4.1. It is the user’s responsibility to check the product, variant, quantity and amount before placing an order.

4.2. Accepting an order does not mean it is fulfilled automatically. The order is processed after its details are checked and confirmed.

4.3. The available payment methods and their terms are communicated to the user when placing or confirming the order. Payment card details are not stored on the Site.

5. 8008 Coin and coupons

5.1. 8008 Coin is a bonus unit that 8008 Gear gives customers for orders and for tasks shown on the Site. Coins are not money, cannot be converted to cash or transferred to another account, and can only be exchanged for the gifts shown on the Site.

5.2. Coins credited for a cancelled or returned order are deducted from the balance.

5.3. Coupons obtained with coins are personal, can be used once only on the account they were obtained on, and are valid for the period shown on them.

5.4. If abuse of the bonus program is detected (fake accounts, fake reviews, interfering with the system), 8008 Gear has the right to cancel the coins and coupons on that account. The program rules are published on the account page and may be changed; changes do not affect coupons that have already been used.

6. Reviews and user content

6.1. A review can only be written about a purchased product and must reflect truthful information related to the product.

6.2. Content that is insulting, discriminatory, false, promotional or violates the rights of third parties is not published or is removed later.

6.3. By posting a review, the user grants 8008 Gear a free, perpetual licence to display that review on the Site and on 8008 Gear’s official social media accounts. Authorship of the review remains with the user.

7. Intellectual property

7.1. The Site’s design, logo, texts, graphic elements and software belong to 8008 Gear and are protected by law. Product names and trademarks are the property of their respective manufacturers.

7.2. Copying, distributing or modifying the Site’s content for commercial purposes without written permission is prohibited.

8. Prohibited actions

• interfering with the operation of the Site or attempting to bypass its security systems;
• collecting data or placing orders using automated tools (bots, scripts);
• creating an account in another person’s name or using someone else’s account without permission;
• using the Site for purposes contrary to the law.

9. Limitation of liability

9.1. 8008 Gear takes the necessary measures to keep the Site running without interruption, but is not liable for interruptions that may occur due to maintenance, internet connection problems or force majeure.

9.2. 8008 Gear is not liable for damage resulting from using a product contrary to the manufacturer’s instructions. This provision does not limit the consumer’s rights provided for by law.

9.3. The Site may contain links to third-party websites. 8008 Gear is not responsible for the content or privacy rules of those websites.

10. Governing law and disputes

These terms are governed by the laws of the Republic of Azerbaijan. Disputes are first resolved through negotiation and, if no agreement is reached, in the manner established by the laws of the Republic of Azerbaijan.

11. Changes to the terms

8008 Gear may change these terms unilaterally. Changes take effect from the moment they are published on the Site; continuing to use the Site after a change means accepting the new version.
