The Buyer is an individual who orders goods for personal, family or household needs and is considered a consumer within the meaning of the Law of the Republic of Azerbaijan “On Consumer Rights Protection”. By placing an order, the Buyer confirms that they are at least 18 years old and have full legal capacity.
2. Subject of the agreement and applicable law
2.1. Under this Agreement, the Seller undertakes to transfer ownership of the goods (gaming gear and accessories) ordered by the Buyer on the 8008gear.com website and deliver them to the specified address, and the Buyer undertakes to accept the goods and pay for them. The name of the goods, the selected variant, quantity, unit price and total amount are shown on the order page and in the confirmation issued with the order number.
2.2. The relations between the parties are governed by the following legislative acts:
- the Civil Code of the Republic of Azerbaijan;
- the Law of the Republic of Azerbaijan “On Consumer Rights Protection” No. 1113 of 19 September 1995;
- the Law of the Republic of Azerbaijan “On Electronic Commerce” No. 908-IIQ of 10 May 2005;
- the Law of the Republic of Azerbaijan “On Personal Data” No. 998-IIIQ of 11 May 2010.
For matters not covered by this Agreement, the current legislation of the Republic of Azerbaijan applies. No provision of the Agreement limits the Buyer’s rights provided for by law.
3. Price, payment and delivery
3.1. Price. All prices on the site are shown in Azerbaijani manats (AZN) and include value added tax where required by law. The order is charged at the price in effect at the time the order was placed; later price changes do not affect an order already placed.
3.2. Payment. Payment is made using the payment methods the Seller offers the Buyer when placing or confirming the order. The payment terms, including the amount and deadline, are communicated to the Buyer before the order is processed. Until payment is confirmed, the goods are reserved for the Buyer only for the period shown on the site.
3.3. Order confirmation. The Seller confirms that the order has been accepted electronically — on the Buyer’s account page and via the contact method provided by the Buyer — stating the order number, the name of the goods, the quantity and the amount.
3.4. Delivery. After the order is confirmed, the goods are delivered by courier to the address provided by the Buyer within 24–48 hours in Baku and within 3–5 business days to other cities and regions. The delivery fee is communicated to the Buyer when the order is confirmed. Detailed rules are given in the shipping policy.
3.5. Handover of goods. From the moment the courier hands the goods over to the Buyer or a person designated by the Buyer, the Seller’s delivery obligation is deemed fulfilled and the risk of accidental loss of or damage to the goods passes to the Buyer.
4. Rights and obligations of the Buyer
4.1. Before placing an order, the Buyer confirms that they have read the main characteristics of the goods, the price, the payment and delivery terms, the Seller’s details and the exchange and return rules.
4.2. The Buyer must provide correct and complete information (first name, last name, address, phone) when ordering. The Seller is not responsible for delays and additional costs caused by incorrect or incomplete information.
4.3. When accepting the goods, the Buyer must check that the packaging is intact and whether the goods were damaged in transit. If damage is found, the Buyer must have it recorded with the courier present and must not accept the goods.
4.4. The Buyer must use the goods for their intended purpose and in line with the manufacturer’s instructions.
5. Rights and obligations of the Seller
5.1. The Seller must hand over the goods in proper quality, complete, in line with the specifications stated in the order and together with the manufacturer’s warranty documents (if any).
5.2. If the ordered goods run out of stock or cannot be delivered due to supply issues, the Seller informs the Buyer within 3 (three) business days and, at the Buyer’s choice, either offers other goods of the same value or refunds the amount paid in full within 7 business days at the latest.
5.3. If an obviously incorrect price is shown on the site as a result of a technical error, the Seller reserves the right to cancel the order after informing the Buyer and to refund the amount paid in full.
5.4. In cases of force majeure (natural disasters, decisions of state authorities, suspension of postal or courier services, etc.), the deadline for fulfilling obligations is extended for as long as those circumstances last.
6. Warranty and defective goods
6.1. The goods are sold with a manufacturer warranty. The warranty period is shown on the product page; where it is not shown, a 12-month warranty applies. Detailed terms are given on the warranty page.
6.2. If a defect that arose through no fault of the Buyer is found during the warranty period, the Buyer may, under Article 8 of the Law of the Republic of Azerbaijan “On Consumer Rights Protection” and at their own choice, demand free elimination of the defect, replacement of the goods with the same or a similar product, a proportionate reduction of the price, or withdrawal from the contract and a refund of the amount paid.
6.3. Defects resulting from mechanical damage, contact with liquid, non-standard voltage, use contrary to the manufacturer’s instructions or repairs carried out by the Buyer are not covered by the warranty.
7. Exchange and return of goods
7.1. Under Article 15 of the Law of the Republic of Azerbaijan “On Consumer Rights Protection”, the Buyer has the right to exchange goods of proper quality within 14 days of delivery, provided they have not been used and their commercial appearance, consumer properties, seals, labels and packaging are intact, and, if an exchange is not possible, to withdraw from the contract and demand a refund of the amount paid.
7.2. Goods that cannot be exchanged for hygiene reasons (for example, earphones whose in-ear parts have been used) and products made to the Buyer’s individual order are accepted back only if they are defective.
7.3. The value of returned goods is refunded using the payment method used within 7 business days at the latest after the goods reach the Seller and are inspected. When goods of proper quality are returned at the Buyer’s own wish, the return shipping cost is borne by the Buyer; when defective goods are returned, it is borne by the Seller. Detailed rules are given in the return policy.
8. Personal data
The Buyer’s personal data is processed in line with the requirements of the Law of the Republic of Azerbaijan “On Personal Data” solely to fulfil the order, deliver it, contact the Buyer and meet obligations provided for by law. More information is given in the privacy policy and the notice on the processing of personal data.
9. Dispute resolution
9.1. Disputes arising from this Agreement are first resolved through negotiation. The Buyer may send a request to [email protected] or +994105558008; requests are answered within 5 (five) business days at the latest.
9.2. If no agreement is reached, the Buyer may apply to the State Service for Antimonopoly and Consumer Market Control under the Ministry of Economy of the Republic of Azerbaijan or bring a claim in court in the manner established by the laws of the Republic of Azerbaijan. A consumer may also bring a claim in the court of their place of residence.
10. Final provisions
10.1. The Agreement is deemed concluded from the moment the Buyer confirms the order electronically and is binding on the parties. Under the Law of the Republic of Azerbaijan “On Electronic Commerce”, a contract concluded in electronic form meets the requirement of written form.
10.2. The Seller may change the terms of this Agreement unilaterally; changes apply only to new orders from the moment they are published on the site. Orders already placed are subject to the terms in effect at the time of ordering.
10.3. The current version of the Agreement is always published on this page with the date of the last update.
